These terms and conditions apply to individuals who participate in the Three Foragers Affiliate Program (the “Program”) as an affiliate (“you”, “affiliate” or “the affiliate”) and refer customers to purchase products from Three Foragers Inc. (“we”, “us”, “our” or “the merchant”). They supplement our Terms of Service and Privacy Policy. If there is a conflict between those documents and these terms on a matter relating to the Program, these terms apply.

By participating in the Program, you agree to use the Program in adherence with these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as an affiliate or participate in the Program in any manner.

1. Eligibility

You must be at least the age of majority in your province or state of residence to join the Program.

2. Approval or Rejection of the Registration

We reserve the right to approve or reject ANY Affiliate Program registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program registration.

Registrations may be screened by automated fraud rules, and a registration may be declined as a result. If you believe your registration was declined in error, you can contact us at info@threeforagers.ca and a person will review it.

3. Affiliate Links and Coupon

Affiliate links are automatically generated, but you can also generate an affiliate link for a specific product or collection. If a person clicks on someone else’s referral link and then later clicks on yours, yours is the one that counts.

An affiliate might or might not be assigned one coupon code, with details and usage clarified in the Dashboard. If a customer clicks on the affiliate link and uses the affiliate’s coupon code, the affiliate will not receive a double commission. If you are not assigned a branded coupon, you are not allowed to promote a coupon.

Affiliates may advertise our website on online channels such as Facebook, Instagram, etc., or may use offline channels such as classified ads, magazines and newspapers.

4. Commissions and Payments

If an affiliate refers a customer to make a purchase on our website, you will receive a commission calculated based on the commission structure described to you. The commission amount depends on the order’s total product value, defined as the amount paid for all products in an order after any product or order-level discounts. It does not include extra fees such as tax, shipping cost, service fees, or any other fees.

To receive a commission, you must provide a PayPal account in Settings. Commissions are paid through PayPal to the account you provide. The payment schedule will be given on the Affiliate Guide page.

Payments will only be sent for transactions that have been successfully completed. A transaction counts as successfully completed upon the customer’s receipt of the products purchased, pending any refunds or exchanges that the referred customer may make. Returns, exchanges and refunds are determined under our Refund Policy. If we send a replacement instead of issuing a refund, your commission is not affected. If an order is exchanged, your commission will be adjusted to match the order’s final total product value after the exchange.

If a customer receives a refund, or an exchange reduces the order’s total product value, after a commission has been paid out, repayment of any excess commission paid out will be deducted from your next payout. If you will not be receiving a payout the following month, repayment will be required within 30 days of your being notified of the refund or exchange. Failure to repay this commission in a timely manner may result in suspension or termination of your participation in the Program at our sole discretion. Refunds and exchanges made more than 90 days after the order date will not affect commissions already paid.

Use of the Program is subject to a fair use policy, which gives us the right to review each and every referral order. Referral orders and commissions may be screened by automated fraud rules, and a commission may be withheld or rejected as a result. If you believe a decision was made in error, you can contact us at info@threeforagers.ca and a person will review it. The status of commissions is displayed in the Commission tab of your dashboard, while any paid commission is listed in the Payment tab. Transactions that result in chargebacks or refunds will not be paid out.

You are responsible for any taxes that apply to the commissions you earn.

5. Marketing Materials

We may share promotional media such as banners, logos, or other promotional material with you through the Marketing tool tab. You can download the media or get the HTML embed code to share on your affiliate channels.

We grant you a limited, revocable, non-transferable licence to use these promotional materials only to promote Three Foragers under the Program. All other rights, including our trademarks and product images, remain with Three Foragers Inc. Section 2 of our Terms of Service otherwise applies.

6. Network

If the Network tab is active, you can invite others to become your downline affiliates. If any downline affiliate brings a qualifying order to our shop, the upline affiliate will also receive a network commission, depending on our settings.

To invite other affiliates into the system, share your network link. Any affiliate who clicks that link and signs up will become your downline affiliate.

7. Cookies

We use cookies to track people who have clicked on your link, so they must be using cookies for us to track them.

If a person doesn’t allow cookies or clears their cookies during use of the site, we are unable to track them or verify the authenticity of the transaction. As such, we will not pay any earnings on that person’s activity.

The referral cookie lasts up to 30 days. It starts from the time a customer clicks on the affiliate’s link or uses the affiliate’s coupon. Within the cookie’s validity period, every order made by the tracked customer on our website, including repeat orders, will automatically result in a commission to the affiliate, even without using affiliate discount codes or clicking affiliate links. 8. Disclosure and Compliance

You must clearly disclose that you may earn a commission on your promotions, as required by applicable advertising law. If you promote by email or text message, you are responsible for complying with Canada’s anti-spam legislation (CASL) and any other laws that apply to those messages.

9. Prohibited Activities

Affiliates must not engage in fraudulent activities, spam, or misrepresent our products or services. You may not earn a commission on your own purchases or those of your household. Section 12 (Prohibited Uses) of our Terms of Service also applies to you. Breach of this section may result in suspension or permanent removal from the Program and forfeiture of unpaid commissions.

Sensitive Traffic Sources Policy

Affiliates must not promote our products through the following sensitive traffic sources without prior written approval:

• Adult content websites or platforms
• Illegal content or file-sharing sites
• Sites promoting violence, hate speech, or discrimination
• Gambling or betting platforms
• Cryptocurrency or high-risk investment promotions

10. Removal from the Program

If you wish to be removed from the Program, you can do so at any time by contacting info@threeforagers.ca.

If, in our sole discretion and using the technology available to us, we suspect an affiliate of breaching these terms and conditions or engaging in behaviour not aligning with our brand, that affiliate may be temporarily suspended from, or permanently banned from, the Program. Our fraud rules may do this automatically. If you believe a decision was made in error, you can contact us at info@threeforagers.ca and a person will review it. We may also end the Program or your participation in it at any time.

11. Disclaimer and Limitation of Liability

The Program is provided “as is” and “as available”, without any representation, warranty or condition of any kind, either express or implied. We do not guarantee that the Program or the tracking will be uninterrupted, timely, secure or error-free.

In no case shall Three Foragers Inc., our directors, officers, employees, agents, contractors, suppliers or service providers be liable for any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits or lost revenue, arising from your participation in the Program, to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend and hold harmless Three Foragers Inc. and our officers, directors, employees, agents, contractors and service providers from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these terms or your violation of any law or the rights of a third party.

13. Changes to These Terms

We reserve the right, at our sole discretion, to update, change or replace any part of these terms by posting the changes on this page. It is your responsibility to check this page periodically. Your continued participation in the Program after changes are posted constitutes acceptance of those changes.

14. Governing Law

These terms are governed by and construed in accordance with the provincial laws of Saskatchewan and the federal laws of Canada.
